Government to Introduce Digital Competition Bill After Due Deliberation

The Indian government is proceeding cautiously and systematically towards presenting the proposed Digital Competition Bill, said Minister of State for Corporate Affairs, Harsh Malhotra. Speaking at the 10th National Conference on Economics of Competition Law in New Delhi, Malhotra emphasised that while there is a strong need for such legislation, it will be introduced only after thorough consultations.

Balancing Regulation and Market Growth

The bill aims to prevent monopolistic practices by large technology firms while ensuring a fair and competitive environment for all players in India’s digital economy. But Malhotra made it clear that the government is not in a hurry and is taking stock of regulatory models from other countries like the European Union, Japan, and Australia and would then decide what would be appropriate for India.

“We recognize the importance of having a Digital Competition Bill, but we want to ensure it aligns with India’s market dynamics and supports both competition and innovation,” Malhotra said. The Electronics Ministry is working on a report that will help shape the final provisions of the bill.

Malhotra emphasized the necessity for companies to implement self-regulation and compliance procedures while arguing for more stringent regulatory measures. He emphasized that India’s market strength and economic future depend on free and fair competition.

CCI’s Concerns Over Big Tech Practices

The Competition Commission of India (CCI) chairman Ravneet Kaur showed concerns over the possibility of unfair business practices and the growing power of big digital companies. One key issue highlighted was the use of AI in pricing models, which can lead to market collusion.

To solve this, authorities are now mostly focusing on raising the openness and responsibility of AI-driven pricing. They are also looking at ways to help companies to pay possible infractions early through the Settlement and Commitment clauses of the Competition Amendment Act, so avoiding protracted legal conflicts.

Implications for Major Players

Global tech firms like Google, Amazon, Meta, and Flipkart that operate in India may be greatly impacted if the Digital Competition Bill is put into effect. Stricter regulation may be coming soon, according to recent cases like the CCI’s decision against WhatsApp-Meta for engaging in anti-competitive data-sharing practices. The Amazon-Flipkart dominance case is under review by the Karnataka High Court right now, which might affect the last clauses of the bill.

With India’s digital economy expanding rapidly, the government is working to find the right balance between encouraging innovation and maintaining fair competition.
